1.3 Retention Period

We also retain personal information in backup systems solely for disaster recovery purposes. Personal information in backup systems will be deleted or overwritten at a later time in accordance with our backup and retention schedule.

4.1 Opting Out of Interest-Based Advertising. If you reside in the United States, depending on your state, you may have additional options beyond those described below to control our use and disclosure of your information for sales, “sharing,” and interest-based advertising purposes. The DAA provides a tool for opting out of cross-app data collection on mobile devices for interest-based advertising.
You need to opt out separately on all browsers and devices, as each opt-out only applies to the specific browser or device you used to opt out. If you delete or reset cookies or mobile device identifiers, change browsers, or use a different device, any opt-out cookies or tools may become ineffective, and you will need to opt out again.
Even if you choose not to receive interest-based advertising, you may still receive ads, but these ads may be less relevant to you.
Some of our partners may offer you additional choices regarding interest-based advertising. For example, some social media platforms allow you to control your advertising preferences directly through their services. 4.2 Unsubscribing from our marketing and promotional communications.
We may send you marketing and promotional communications from time to time, including special offers from us or our partners. If you no longer wish to receive promotional and marketing emails from us, you can unsubscribe at any time by following the unsubscribe instructions in any promotional or marketing email you receive.
4.3 Privacy Rights and Requests.
Depending on your state of residence in the United States, you may have certain rights regarding your personal information, including:
Right to Know: You have the right to know what personal information we collect about you, including the categories of sources from which personal information is collected, the business or commercial purposes for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, the categories of personal information disclosed to third parties, and the specific pieces of personal information we have collected about you. We may not be required to respond to more than two “right to know” requests or requests for access to specific pieces of personal information within any 12-month period.

Right to Opt-Out of Certain Types of Personal Information Use and Disclosure: We use and disclose personal information to third parties for analytics and advertising purposes. Therefore, you have the right to opt out of the “sale” or “sharing” of your personal information, or opt out of the use of your personal information for “targeted advertising” (as these terms are defined under applicable law). Right to Limit the Use or Disclosure of Sensitive Personal Information: You have the right to request that we limit the use or disclosure of your sensitive personal information, subject to certain exceptions.
Please note that, where permitted by applicable law, we may deny your request (except for opt-out requests) if we are unable to verify your identity (or the authorization of the agent making the request) and confirm that the personal information we hold relates to you.
We will not discriminate against you for exercising your privacy rights.
4.4 Agent Requests
Only you or a person legally authorized to act on your behalf may submit requests related to your personal information.
Depending on your state of residence in the United States, you may authorize another person (an authorized agent) to submit privacy rights requests on your behalf. The authorized agent will need to demonstrate that you have authorized them to act on your behalf. HEYDUDE reserves the right to contact you directly to confirm whether the agent is authorized to make such requests, or to request additional information from you to verify the agent’s identity.
4.5 Opt-Out Requests
Submitting an opt-out request does not require you to create an account with us.
4.6 Right to Appeal

4.7 Financial Incentive Notice
We may offer financial incentives to promote our products and services. You can learn more about currently available financial incentives by visiting our website. These incentives may include:
Discounts, coupons, and special offers for signing up for our email list, participating in marketing promotions or sweepstakes, or creating an account.
Points programs where you can earn points for certain purchases, which can be redeemed for discounts or coupons.
We may request personal information from you in connection with these promotional activities, including the following personal information: name, email address, and phone number. Because these promotional activities involve the collection of personal information, they may be considered “financial incentive” programs under California law, or “bona fide loyalty programs” under Colorado law. Participation in any financial incentive program is voluntary. To stop receiving coupons or discounts from us via email, you can unsubscribe by clicking the “unsubscribe” button at the bottom of any such email. If you request that we delete your personal information, we will not be able to provide you with access to these programs.
The value of any financial incentive we offer is reasonably related to the value of any personal information you provide to us. When we assess the value of your personal information, we consider, but are not limited to, the following factors: the costs incurred by us in collecting your personal information and/or providing you with the financial incentive, the revenue generated from your use of the financial incentive, and any improvements we can make to our products and services based on aggregated information obtained through the financial incentive program.

- Children’s Privacy
Our services are intended for general audiences. We do not specifically target our services to individuals under eighteen (18) years of age, nor do we knowingly solicit or collect any personal information from minors.

We have implemented physical, administrative, and technical security measures to maintain the security, confidentiality, and integrity of your information. However, because information transmission over the internet is not completely secure, we cannot guarantee the absolute security of your information.

We reserve the right to change, modify, add, delete, or otherwise revise portions of this Privacy Policy at any time at our sole discretion. We will post any changes to our services. Your continued use of our services after the posting of these changes constitutes your acceptance of these changes.
